Middletown man convicted of child sex charges

A Middletown man was found guilty of two counts of child sex charges Tuesday night following a two-day trial.

James M. English, 38, formerly of Columbia Avenue, was convicted by a Butler County jury of two charges of gross sexual imposition involving girls under the age of 13. The jury was hung on a third count of gross sexual imposition and common pleas Judge Craig Hedric declared a mistrial on the final charge, according to Assistant Butler County Prosecutor Jennifer McElfresh.

English has been in and out of prison since 1995. In November, English was sentenced to nine years in prison by Hedric after he pleaded guilty to a rape charge for a crime that occurred in Middletown in September 2011.

Gross sexual imposition is a third-degree felony with a sentence of up to five years in prison and a $10,000 fine. English is scheduled to be sentenced March 13 for the latest two convictions. Butler County Prosecutor Michael Gmoser said the county will not retry English on the third charge.

“There was enough justice served with the two convictions,” Gmoser said, adding another trial would further traumatize the young witness in the case.

English was convicted on gross sexual imposition and sexual battery charges for two cases in 1995 and 1996. He was sent to prison for 4½ years. In 2000 he went to prison for three years for gross sex imposition. In 2003 he had an escape charge and was sent back to prison for two years. He had another escape charge in 2006 and received an additional year behind bars. He failed to register his change of address or job status in 2008 and was sentenced to two more years in prison.
