Woman arrested after police find marijuana near baby

MIDDLETOWN —

A Middletown woman was charged with several offenses after Middletown police were called to her apartment in the 100 block of Bavarian Street last week.

Police were dispatched to the apartment on a report that Robin Smith, 26, was smoking marijuana around her children, 2 years old and 7 months old. When police arrived around 5 p.m., they found Smith carrying a white plate with a yellow, powder residue on the plate. She told police it was crushed Vicodin and she was using it because she had a toothache.

Police observed two straws on the dresser and a baggie of marijuana that weighed 3.38 grams on the floor. The 7-month-old, police said, was lying on the bed and when he rolled over, police saw a burnt marijuana joint near the baby.

Smith was charged with child endangering, drug paraphernalia, drug abuse/marijuana and drug abuse/schedule III drugs. When she was taken into custody, and transported to the Middletown City Jail, two other people in the apartment told police they could care for the children.

Police were later called back to the apartment on a report of found property. Police were given a bag that was found under Smith’s mattress that contained some crack pipes.

Visiting Judge Larry Moore in Middletown Municipal Court, sentenced Smith to 180 days, but suspended 178 of those days and placed her on two years probation.
