Couple who videotaped sex acts with teen sentenced to eight years in prison

LEBANON —

The Warren County couple accused of videotaping sex acts they had with a 16-year-old boy are going to prison for eight years.

Leah and Benjamin Rodgers, 35 and 37 respectively,of South Lebanon, apparently labeled their sex videos with titles such as,“Jailhouse Films Volume 1” and “Best Of.” That’s what landed them in court and now prison on six sexual battery charges, four counts of producing sexually-oriented material involving a minor and four counts of possessing the videos.

The pair pleaded guilty as charged last month and Assistant Prosecutor Travis Vieux said as part of the plea, they agreed to a maximum 10-year sentence, as opposed to the maximum 68 years the charges warrant.

“What the offenses are really about is manipulation of a child,” Vieux told Judge Neal Bronson. “The justifications put forward by Mr. Rodgers in this case indicate an attitude by him that really would justify his criminal involvement and sexual perdition of any member of his family or other members of the community… The statements of the victim really address the impact on this child and the age of the child made him particularly vulnerable to this activity.”

Benjamin addressed Bronson wearing a striped jail jumpsuit, which he acknowledged is the garb of a jail troublemaker. He told Bronson he hasn’t caused any trouble in the jail — he is being kept away from other inmates for his own protection because of his crimes.

Through tears he apologized, saying he has been on drugs but that wasn’t an excuse.

“I’m sorry for my wife. I knew her history. That was a mistake I never should have made,” he said. “(To the victim)… I’m sorry. I know my mom is here and I apologize to her. I apologize to all of you. I can’t justify, I’m not even gong to try and justify what I did. It was wrong.”

Leah’s attorney Lou Rubenstein told Bronson his client was raped by her father, she was living on the streets and turned to prostitution and drugs. He blamed the victim, saying the teen controlled when they had sex. Leah tearfully apologized.

“I’m so sorry I hurt my family by my actions,” she said. “I didn’t mean for it to happen, I didn’t mean for it to go this far… I hope that one day they all will forgive me.”

Prosecutor David Fornshell said he understood why Bronson ruled the way he did, giving the couple credit for cooperating fully with the investigation.

“At the end of the day, given what typically happens in cases like these, I was satisfied with the sentence,” he said. “It was a couple years short of what we had agreed to do in terms of a plea, but I was nonetheless satisfied.”

Rodger’s mother Karen Brosemer said her son was in a “dark place” as a teenager, but she has to forgive him.

“I won’t forget for a long time, but you can forgive,” she said. “I have to forgive. You don’t forgive, God won’t forgive you.”
