2 arrested for having weapons while intoxicated

MIDDLETOWN —

Two Middletown residents were arrested Monday morning and charged with having weapons while intoxicated, according to Middletown police.

Police were called to Vannest Avenue on reports of shots being fired. They were directed to a home in the 3900 block of Riverview Avenue. The lights were on in the house, and when police looked inside they saw Robert Fugate, 22, sitting on the floor, cleaning an assault rifle, according to the report.

Police also saw Amber Branstetter, 26, of Riverview Avenue, lying on the bed. Additional police were called to the scene. When police knocked on the door, Fugate grabbed a shotgun and walked toward the front door, and Branstetter picked up a rifle.

Both were told to drop the weapons by police. Both appeared to intoxicated, police said. A 4-year-old boy was asleep on the couch. Branstetter told police she heard someone in the back yard and she fired a shot from a .22 caliber handgun. Two other weapons, a .12 gauge shotgun and a assault rifle were confiscated.

The 4-year-old was picked up by a relative.

When Branstetter was searched in jail, she was found to have a clear straw with a white powdery substance on the end. She allegedly told police she used the straw to snort Percocet pills. She was charged with possession of drug paraphernalia.
