Mother of child who fell out of third-story window arrested

By Hannah Poturalski

HAMILTON — Police have arrested the mother of a 3-year-old girl who fell Friday morning from a third-story window onto concrete.

Miranda Maggard, 29, of 502 S. Monument Ave., Apt. 5, is charged with child endangering, a third-degree felony, according to police.

Police reports say Maggard was not in her residence around 8:45 a.m. at the time of the fall, which is believed to be an accident. A female bystander who made the 911 call told dispatchers she couldn’t find the child’s parents.

The child was left unattended and was able to climb onto a table and eventually fell out of the third-story window, according to a police report.

Officer Rich Burkhardt said the child was first taken to The Fort Hamilton Hospital before being taken by medical helicopter to University Hospital in Cincinnati.

“She took a pretty good spill onto the concrete,” Burkhardt said. “She’s in pretty bad shape.”

Police say the child is under observation with non-life threatening but serious injuries.

A neighbor said the windows at Neilan Park Apartments are too high for a small child to look out of. Early this afternoon, the window neighbors said they child fell from remained open.

“I can’t believe it,” said Shawetta Graves, who knows the child’s mother. “I wish I’d seen it so I could have saved her.”

Maggard has more than 20 prior charges including drug abuse and domestic violence, according to Hamilton Municipal Court records,
