HAMILTON - A Cincinnati former pro wrestler who is HIV positive and had unprotected sex with a dozen women - including one in Butler County - was sentenced Wednesday to 30 months in prison.
Andre Davis, 30, pleaded guilty May 4 in Butler County Common Pleas Court to a third-degree felonious assault charge as part of a plea agreement. He was originally charged with a second-degree felony.
Judge Keith Spaeth sentenced Davis as his victim watched from the courtroom.
Davis was sentenced in Hamilton County court last year to 32 years in prison after a jury convicted him of having sex with 11 women and not telling them he was HIV positive.
Davis, who while wrestling called himself “Gangsta of Love,” won’t spend any more than the 32 years he is already serving because Spaeth ran this new sentence concurrent to the one imposed in Hamilton County. The single victim was crying quieting in court, but decided not to speak at the hearing. Davis turned to her and told her he loved her.
“I love you and I apologize, I am very sorry ...,” he said. “I pray that you can forgive me, that’s all I ask.”
Assistant Prosecutor Brad Burress said after the hearing the victim was satisfied with the apology and that’s why she didn’t speak up in court. He added she has been tested and is disease-free and not under a doctor’s care.
Davis’ attorney, Greg Cohen, said his client is addicted to sex and didn’t consider the consequences. The victim used to be a close friend, according to Cohen.
“He violated her trust,” he said. “There’s nothing that would have predicted this conduct.”
Davis also faces nine charges in Warren County and is scheduled to stand trial in late summer. There are four victims who were all also victims in the Hamilton County case, according to Cohen. He said that case will definitely go to trial and he can’t fathom why Prosecutor David Fornshell would put the women through the stress and embarrassment of another trial.
“Back when I played football we had a penalty called piling on,” he said. “I think it’s just piling on. It’s inconceivable why they find it necessary to put these woman through trial, when they’ve already spoken ... The question is whose need is being served here.”
Fornshell said in the unlikely event the Hamilton County case is overturned on appeal, he doesn’t want to risk giving Davis minimal prison time on a plea deal. Fornshell said Davis allegedly committed crimes in his county and it is his responsibility to prosecute offenders.
“The fact that we have the same victims is a complete non-issue, he’s just continuing to put them at greater and greater risk,” he said. “That’s like saying he shot at the same people with a handgun in Hamilton County, so we shouldn’t prosecute him for the time that he shot at those people in Warren County. That is an absurd argument.”
