TRENTON — The City of Trenton has settled a lawsuit with a sheet metal company that worked on its wastewater treatment plant, agreeing to pay the company $587,500.
City Council legislated the settlement during a special meeting held Thursday, July 30.
City Manager John Jones said the company Orbit Sheet Metal, based in Dayton, sued the city in 2006, alleging nonpayment. The city countersued Orbit, claiming it was never given proper billing for its services, Jones said.
The city and the company reached an out-of-court settlement, which the city is paying for through the issuance of bond anticipation notes. This action was combined with the purchase of a new dump truck for the city in order to obtain a better interest rate, said the city’s treasurer, Mike Engel.
The dump truck costs $66,196, and associated equipment, including a a stainless steel dump bed, salt spreader, snow plow and safety chains, costs $36,065.
All told, the city legislated a maximum of $700,000 in bond anticipation notes to finance the dump truck, equipment and the legal settlement.
The city’s service director, Rob Leichman also informed City Council Thursday that CSX Railroad would be installing a crossing gate South First Street. Leichhman estimated it would be about nine months before the gate is in place.
