Danny Miller is $200 short on the rent for his home in Franklin, and it may be the last time he'll be able to get a loan to get him through.
"I hate that I have to use payday loans but it helps me when I need a little extra," he said.
The 45-year-old electrician said he's used the loans about seven times this year because his schedule was cut down to about 45 hours a week. He needs every hour he can get to dig him out of bankruptcy, pay child support for his two young daughters and cover their health insurance, which has gone up over 57 percent in the last year, he said.
So Miller said today, Nov. 6, he will go to a payday lending center for the missing rent money and pay the loan back in two weeks when his paycheck comes in. But next time, since voters passed Issue 5, which limits the amount and value borrowers can get from such establishments, he said he's not sure what he'll do.
"I might have to get a part-time job, but I don't have a car and use the bus (so) that kind of limits things," he said.
And his credit?
"Not so good right now," Miller said, so a credit card or traditional bank loan will be out of the question in these tough financial times where no one is lending.
Bill Faith, executive director of the Coalition on Homelessness and Housing which was in favor of Issue 5, said the passage of payday lending caps will protect residents from being prey to a corrupt financial scheme.
"Ohio voters stripped payday lenders of their permit to fleece working people," Faith said.
But to Miller, that is hardly the case.
"I can make decisions for myself. It takes away options. It should be a person's right to choose whether they need payday loans or not," he said.
Issue 5, which 69 percent of Ohio voters approved, effectively cut the annual percentage rate payday lenders can charge from 391 percent to 28 percent and limits the number of loans customers can take out to four per year.
For at least eight months of the year, Miller said he's going to have to find new ways to make rent.
"For a lot of people, it's just going to make things more difficult when they are already difficult enough," he said.

Jodi is AWESOME! I, too voted YES! AND I have used PayDay loans this year. Recently! What happened? I got caught in a vicious cycle of having to borrow again before the other checks cleared in order to pay off the first loan. Something ALWAYS seemed to come up. I’m GLAD that I will NEVER get stuck in this vicious cycle again. And for those of you vulnerable enough to think that Jodi is actually sitting at her desk at 5/3 bank, get REAL!!! I gotta get back to WORK now!

Looking over all of these comments it looks like the overwhelming # of people that use these loans will miss them.
I know a lot of people that use them. They range from university professors to elementary school teachers. Lot’s of times they are used in emergencies to visit a sick or deceased relative or to fix a broken part on their car.
People that use these loans are not dumb or poor. No one likes to pay high interest rates but sometimes its nice to have this option. (Oops was nice.)

People also misuse credit cards, are we going to limit the number of times a year someone can use thier credit card because a small percentage of people misuse them. Give me a break, you can’t be responsible for everyone, one day these people will just have to grow up and be the adults that they and learn to make thier own choices.

Rikki, toby and others opposed to payday loans. It isn’t that they are good or bad or even missused, anything can be bad and misused. It is all about the freedom of choice. I have used payday loans a time or two, was not what I wanted to do but under the circumstances of the time I needed the money and it was nice to have the choice. Some people misuse food and alcohol how about putting a band on those things next.

I think her problem is, she is one of those people that has abused the pay day lenders, and probably owes them money and hopes that they all close and then she wont have to pay them back the money she owes.

Rather than voting to protect the people of Ohio from the big bad pay day lenders, I suggest the 69% that voted to limit the APR to 28% interest take the following figures into account: 1) JOE BLOW needs $100. JOE receives the $100 and repays the lender $115.00 two weeks later. 2) When the new law becomes effective, JOE would borrow the $100 and return a total of $101.08 to the lender two weeks later. QUESTION: How many of you would invest $100 for a profit of $1.08? If not, U R the PROBLEM!

I have never used a PAY DAY LOAN company, but the option should be my option, not your option to choose for me!
I don’t need others protecting me from myself. I have the capability of judging for myself what is best for me!
However, you may consider authoring a referendum in the Ohio state legislature to protect me from cell phone users with their phones glued to their ears or those texting while driving without regard to their surroundings or my safety.

Limit this wtf. then lets limit court costs and power of imprisonment if you can not afford to pay a fine or ticket. Let those who ride decide then let those who borrow choose to borrow or not. The banks are obviously behind this issue. The big timers running the little bussiness out of business. I live in Dallas Texas & we have these PayDay Loan places EVERYWHERE, even inside pawn shops! A friend of mine got a loan for $500 for medication she needed & couldnt afford. The meds ended up being long term & cost so much she still cant afford them. After paying the loan, she cant buy the meds, shes forced to go back & get yet another loan. I call this “Legal Loan-Sharking”! Great when you need it, but Hell if you get caught up in it! Its a scary process to get involved with!

Did you ever give it a thought that your remark about Jodi being at work using the computer. How do you know she was at work while using the computer, maybe she was off and at home. It’s time for pay day lenders to stop ripping off people. Many of these people that get money from there need it right away to buy their drugs and beer, maybe now they can’t get it as easy. I worked at a pay day loan collections office. And I am sorry if any of you want to start on me now b/c of what i say. but i voted yes also.. I worked there for 4 years. Been through every meeting they had.. And seriously all they do is think of ways to get more money out of you. I would not lie.. I think they are the most ridiculous places ever.. You think they may help you, ok and if you don’t abuse them then go for it. No one can run your life but you.. But I do knw 1 mistake and stuck.

For the record Cashland will still be doing payday loans there will be new product coming out at the beginning of next month for those who will still need our help. Jodi, you might not “choose to be a victim” but you are very much a victim. Angie you are right if you use them correctly, the problem is the people who misuse them will miss use anything. I worry about people not getting themself out of the loans in time and have to resort to possible illegal means of making up for sort falls. I hope that people do not, but when you are desperate you will do anything to keep the heat on or feed your kids.

I have to say that i have in the past used pay day loans and they got me into a lot of trouble. I felt like once I paid one off i had to borrow again just to make it thyrough that week. If you use them correctly and not like me then they can be ok. But, because of my experience I did vote to limit them.

I actually thought that ohioans were going to buy the jobs argument that the pay day lenders put out there, but then I realized that- suprise- people read! 66% voted yes on issue 5- 66%! Lenders got killed amongst every single demographic. Republicans voted yes. Democrats voted yes. Young and Old. It may have been one of the single most uniting initiatives ever in our state. The campaign was based on fear and in the end, poor people are going to have to walk an extra block to find a lender.

you all might be surprised. Most pay day loans places arent doing any more loans but are not telling customers that. So for those who are in that paying back, borrowing back the next day. when you go to pay back your loan, once they have the money in their hands then they will tell you they are no longer doing loans.

I work everyday of my life… except for those much earned vacations days. I wasn’t born with a silver spoon in my mouth. In fact, my mother struggled her entire life to make ends meet. I still find it difficult and live pay check to pay check most of the time. The difference between us is I choose not be a victim.

I get a kick out of this. Limit PayDay Loans and make an error in your checkbook and the bank can charge you $37.00 for each check bounced or where overdraft was used, even if the check is for $5.00. Have seen people at the bank rack up $200-300 in checks fees in one day. Gotta love government logic.

Let’s do some basic math here people. 391% = $15 for every $100 borrowed. So, $200 borrowed equals $30 in fees. Bank overdraft charges, $29-$39 per transaction…even if only for $3.78! Add to that places like Fifth Third bank, where they charge DAILY, and what do you get?? Answer= a hell of a lot better deal through a payday lender. People, worry about yourselves and don’t act like Big Brother when comes to other people’s money. Plain and simple. Do you pay my bills?

What a racket! That is legalized usury to be able to charge 391%. Heaven forbid you can now only get 28% interest. The people of Ohio have spoken clearly - DO NOT TAKE ADVANTAGE OF US OR OUR FRINEDS AND FAMILIES! There are social service agencies that help with utilities and rent and never once were they informed of that by the Payday Sharks. Lets be real here - it was use and abuse of other human beings. Enough is enough. Ohio Citizens did the right thing and have spoken LOUDLY!

and for those who believe people were being taken advantage of - there ARE predatory payday lenders out there, just as some mortgage lenders were out there. BUT, there were a LOT more payday lenders who HELPED people get OUT of the cycle, so as not to risk these people not being ablt to pay their rent, utilities, or even food. If you dont know the issue COMPLETELY,m then by all means - LEAVE THE DOGGON THING BLANK!!!!

Con’t - The rest of the companies that cannot find other means to stay in Ohio will pull out byt the end of 2009, which will cause another 7200 people in this state to lose their jobs. Funny thing is - banks are a bigger rip off with NSF fees - where is the law to protect the citizens of Ohio fronm the banks? 5/3 charges $28 every day until that negative amount is paid off. Come on - go after the big banks - leave the payday lenders and check cashers alone for God’s sake!!

just to let everyone know-1700 people have already lost their jobs when Strickland first passed this law due to 2 companies pulling out of the state, I know for a fact another company has shut down 80% of their stores, causing those people to lose their jobs as well. The State of Ohio charges $600-$700 for a State license, its not that easy to get either. They have rent, utilites, payroll, taxes, etc they have to pay too. With the new law-they can’t afford to stay in Oh.

Do you people that are complaining realize how many elderly people were taken advantage of? Stop being selfish, think of others, and find another way to get by. I bet many of you that are complaining about not being able to pay your bills, have cell phones, and direct TV, and many other luxuries don’t you! In some cases it all about choices.

You can be as angry as you like it will not help anything. You need to be proactive and find another way to make ends meet. Call me a do-gooder, fine. But this was obviously mine and all the other Ohioan’s that voted to pass the issues business. I can totally empathize with all of you about not being able to pay bills and the sense of worry you feel. But, what is done is done.

Where is our freedom?
It’s long gone and that’s something we need to get back. But we can’t get it back when we have the rich snooty people in control of everything. So for us people that know what a hard life means and live the hard life everyday, but who cares we always get the short end of the stick every time. We work every day and pay our taxes just like the snooty people and yet we still struggle with today’s society.
My point is the payday lenders are there to help and have helped tons of people, and yes there are a few people that have abused the lending company but that’s not everyone’s fault. So why are we being treated like kids, when we are grown adults and responsible for our actions. So if the lending companies are the blame for people getting themselves in financial problems. Then way isn’t the Government the blame for the gas prices that have put people in tight situations which cause them to have to use the payday lending companies to help get them threw the rest of the week till they get paid again. The cost of everything has gone up and has made it so hard for people that are low income families.
If taking this away from people that need it to help put food on the table to feed their family, and to keep a roof over their head and put gas in their cars to get to work to try to make a pay check makes you guys happy then I guess our welfare system will gain more applicants everyday do to the fact they cant afford to work nor support their family. If that happens then I guess the snooty rich tax payers will see that they should have left well enough alone because now they are going to be paying for people to use the welfare system.
So I guess I will be heading to the welfare office to stand in line for assistance because I work and pay taxes and cant afford to feed,house,and put clothes on my kids back. Because the government would rather help people that don’t need help.
So no matter how much you work and try you will never get anywhere living in this society, maybe we should move to Mexico and see if we get the free stuff they get from us here.

Ever Heard of Democracy Kim? I elected to vote yes as many Ohioans’ did. I have had financial problems as well but have never turned to Pay Day Loans as a resolve. There are a lot of things wrong with Financial Institutions that we have no control over. This problem ,we luckily got to vote on and it was overwhelmingly decided by the voters to pass it. It may hurt some, but in the long term in will help many!

I have never had to use any payday advances but my boyfriend has. It was comforting to us to know the option was there if we needed it. As for many of us, we have no credit (not bad credit, just no credit) and there isn’t a bank anywhere to help out when times hard. Everyone runs into unexpected problems, requiring money, of course. Alot of us don’t have family or friends to borrow from. I think it is a bunch of bull that now, we, as americans, the land of the free, have had restrictions put on

My heart breaks for those of you who desperately need the payday loans and will be affected by issue 5. I have used payday loans myself and it was one of the biggest nightmares I have ever experienced. I borrowed the money, but lived so tight that I could not afford to pay it back after 2 weeks and then had to continually keep taking the money out again. It is such a nasty cycle and the fees drain you. Really, issue 5 is a no-win situation for everyone.

I am a payday loan user. I admit that. I also admit that I am trapped in the cycle because the fees kill me everytime I have to pay back. I am glad the fees will be less & I feel that if they do give you more time to pay that I can get myself out & break free from them. I have also talked to the one I go to & they have applied for a license that will still allow them to loan money out it will just be a money order instead of cash and the fees will be less & you can borrow more than 4 time a year

This is an overwhelming victory for Ohio’s consumers. Over 3 million Ohio voters strongly repudiated 10 years of predatory payday lending and asked for a return to fair and responsible lending! This is a positive development for Ohio’s families, communities and economy!

Let me say ! Thank you fellow voters of ohio. This payday lending thing is the worst ripoff i have ever saw. I have known of people losing their homes because of these places. I am just thankful that ohio has lawmakers willing to stop such nonsense. The next thing that needs to go is rent to own furniture stores, and after that payday car sales. All these are schemes to rip folks off.
