Dayton restaurant owner pleads not guilty to 4 felony counts

Eva Christian, owner of the Boulevard Haus restaurant in Dayton’s Oregon Historic District, pleaded not guilty this morning, March 22, to four felony counts relating to alleged insurance fraud.

Springboro attorney John D. Smith entered the not-guilty pleas on behalf of Christian, who watched the video arraignment from a room in the Montgomery County Jail where she has been held since her arrest Friday. Montgomery County Common Pleas Judge Timothy N. O’Connell set bond at $10,000.

Smith requested the bond, telling the judge in court this morning, “Any suggestion that (Christian) is a flight risk is exaggerated” and noting that Christian owns a home and a business locally.

Christian is charged with two counts of insurance fraud and two counts of making false alarms in connection to a burglary and vandalism incident that she reported at her now-defunct Cena Brazilian Steakhouse restaurant in Miami Twp. in December 2009 and a break-in and burglary she reported at her home at 6855 Saint Laurent Circle in October 2009.

One of the insurance fraud counts is a third-degree felony, punishable by up to five years in prison, and the other is a fourth-degree felony, punishable by up to 18 months in prison. One of the making false alarms counts is a fourth-degree felony, and one is a fifth-degree felony, punishable by up to a year in prison.

Detectives with the Miami Twp. Police Department and the Montgomery County Sheriff’s Office investigated both incidents and “determined that both burglaries were faked,” Greg Flannagan, spokesman for the Montgomery County Prosecutor’s Office, said Friday after a grand jury indicted Christian.

Christian received $52,000 for her claim of damage and lost property from the Cincinnati Insurance Company, which insured Christian’s home, according to the insurance company’s civil lawsuit filed against Christian in July 2010. The insurance company is attempting to force Christian to cooperate fully with their probe of the claim, and its attorneys said in court filings that Montgomery County Sheriff’s Office investigators suggested to insurance company investigators that Christian may have hired someone to stage the burglary. Christian reported that televisions, computers, jewelry, purses, rare coins and cash in dollars and European currencies had been stolen during the break-in.

The sheriff’s office executed a search warrant at Christian’s home on Jan. 20, 2011, about three months after the break-in was reported, and, “numerous items she had reported stolen were recovered from her residence,” according to the insurance company’s civil lawsuit against Christian. The civil case is scheduled to go to trial on May 16.

Christian opened Cena, a Brazilian steakhouse, in late 2007 at 2854 Miamisburg-Centerville Road in front of the Dayton Mall. The restaurant filed for Chapter 11 bankruptcy — in which businesses reorganize and seek to resolve their debt problems while continuing to operate — in August 2009.

The restaurant reported a burglary and vandalism that occurred after closing on Christmas Eve 2009. Christian said vandals sliced sofas and chairs, broke lamps and cut electrical cords. Shortly after Miami Twp. police investigators left the scene during the early-morning hours of Christmas Day, firefighters were called to put out a small fire at the restaurant, which never reopened after the incident.

Christian’s other restaurant — Boulevard Haus at 329 E. Fifth St. in Dayton’s Oregon Historic District — has been a turnaround story. The restaurant filed for Chapter 11 reorganization bankruptcy in April 2009 when it was operating as Cafe Boulevard, reorganized, changed its name in November 2009 when it started serving German cuisine, made profits throughout the second half of 2010, and emerged from bankruptcy entirely in December 2010, according to U.S. Bankruptcy Court records.

The criminal case has been assigned to Judge Barbara P. Gorman.
